Definitions of Assault and Battery
Assault and battery are defined in Section 30 of the New Mexico Statutes.
There are three types of acts that may be cause for an assault charge:
- An attempt to commit battery upon another person
- An unlawful act, threat or conduct that causes another person to reasonably believe he or she is in danger of battery
- Insulting language that diminishes a person’s honor or reputation
Battery is defined as “the unlawful, intentional touching or application of force to the personal of another when done in a rude, insolent or angry manner.”
If assault and/or battery involved a household member, you may be charged with domestic violence.
